PRIVACY POLICY

Dear Interested Party,  

PhysioFlaminio has great respect for the privacy of its Users. 

The data that may be communicated through the Site (below described) will be treated with the utmost care and with all the tools necessary to guarantee their security, in full compliance with the current legislation aimed at protecting data confidentiality. We wish to inform you that the "European Regulation 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data" (from now on "Regulation” or “GDPR”) provides for the protection of natural persons with regard to the processing of personal data as a fundamental right. Therefore, pursuant to Article 13 of the GDPR, we wish to inform you of the following.

1. COS'AND FISIOFLAMINIO 

FisioFlaminio is a brand of professionals who offer their patients first-class healthcare. FisioFlaminio's doctors specialize in physiotherapy, orthopedics, postural exercises, cosmetic surgery, and nutritional biology. 

In particular, FisioFlaminio provides technical and healthcare services to support its patients. Andrea Sgambati, in compliance with the GDPR Regulation, acts as Data Controller, in reference to the data communicated by Users when browsing the Site. 

By accepting the following privacy policy, the User declares that he or she is aware that his or her personal data may also be disclosed to third parties, always for purposes related to the provision of services.

2. GLOSSARY 

Collaborators” are Francesco Pezzillo, Giulia De Pilla, Gennaro D'Orsi, Paola Marotta and Harris Nikolakakis who, within the scope of their specialization, collaborate with the Owner to provide the technical health services referred to on this Site. 

Personal Data” any information relating to an identified or identifiable natural person, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person. 

“FisioFlaminio” it is the brand with which the Owner and his Collaborators provide the service. “Data Controller” the natural person, legal person, public administration or any other body that processes personal data on behalf of the Data Controller. 

Website” is the current website owned by Andrea Sgambati. 

Holder”the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data and the instruments used, including the security measures. 

User(s)” and/or “Interested party/ies” the individual who uses this Site to whom the Personal Data refers. 

3. CDATA CATEGORIES 

The Data Controller may collect Personal Data and other information directly from its Users as part of the contact process on the Site (this includes, by way of example and not limited to, data such as: email address, name and surname). 

The object of the processing may be the personal data of Users such as:  

a. Data provided during the Contact phase

FisioFlaminio will process the personal data provided by the User in order to directly contact FisioFlaminio professionals. This data is provided directly by the Data Subject and may include contact information, This includes, but is not limited to, the name, surname, email address, and other data voluntarily provided by the User. If the User authorizes it, or through the use of cookies, the Data Controller and its collaborators may store the data provided by the User, in compliance with the principles set forth in European Regulation 679/2016 and in accordance with the purposes set forth in this document. It is understood that the Data Subject has the right to request the deletion of personal data provided during contact at any time. 

b. Data collected automatically.

The computer systems and applications used to operate the Site may, during their normal operation, collect certain data (the transmission of which is implicit in the use of Internet communication protocols) potentially associated with identifiable users. The data collected includes the IP addresses and domain names of the computers used by Users connecting to the Site, the URI (Uniform Resource Identifier) addresses of the requested resources, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response from the server (successful, error, etc.), and other parameters relating to the operating system, browser, and IT environment used by the User, the name of the Internet service provider (ISP), the date and time of the visit, the visitor's referral web page, and the exit web page.  

c. Data provided voluntarily by the User.

The voluntary and explicit sending of emails to the addresses indicated in the various channels on the Site does not require consent and entails the acquisition of the sender's address and data, which is necessary to respond to requests, as well as any other personal data included in the message. This data is considered voluntarily provided. By sending a text message, the User expressly accepts this document. 

d. Cookie

The Site uses cookies. The data collected through cookies may be used to access certain parts of the Site, for statistical purposes, or to make the browsing experience more enjoyable and efficient in the future, attempting to evaluate user behavior and modify the content offered based on their behavior. 

e. Plug-in.

The Site may also incorporate social media plugins and/or buttons to allow easy sharing of content on social networks. These plugins are programmed to avoid setting cookies when accessing the page, to protect user privacy. Cookies may be set, if required by the social networks, only when the User actively and voluntarily uses the plugin. Please note that if the User browses while logged in to the social network, they have already consented to the use of cookies delivered through this Site when registering with the social network. The collection and use of information obtained via the plugin are governed by the respective privacy policies of the social networks, to which we encourage you to refer.

4. SOURCE OF PERSONAL DATA 

The Personal Data held by the Data Controller is collected directly from the Data Subject through the voluntary completion of specific requests during Contact.

5. PURPOSE OF DATA PROCESSING AND LEGAL BASIS 

The processing of User data has the following purposes and legal basis: 

1. Data provided during Contact

Purpose: User request 

Legal basis: legitimate interest of the User. 

2. Maintenance and improvement of the Site

Purpose: use of aggregated and anonymous data to improve the Site. 

Legal basis: legitimate interest of the Data Controller.

3. Detect or prevent fraudulent activity

Purpose: detect, prevent or stop fraudulent activity on the Site. 

Legal basis: legitimate interest of the Data Controller and legal obligation. 

4. Compliance with orders of the judicial authority

Purpose: comply with legal obligations. 

Legal basis: legal obligation. 

5. Data collected automatically

Purpose: ensure and improve the service experience. 

Legal basis: the legitimate interest of the Data Controller. 

6. Data provided voluntarily by the User,  

Purpose: this is the purpose inherent in the request to enter that data. 

Legal basis: User Consent. 

Providing Personal Data for the purposes set out in point 1 of this article is necessary to allow the User to contact FisioFlaminio directly. Therefore, without the aforementioned data, it will not be possible to take advantage of this opportunity. 

6. DATA OF MINORS 

The Data Controller does not collect personal data from minors under the age of 14, in compliance with the provisions of Legislative Decree 101/2018. Users who provide false information during registration expressly release the Data Controller from any liability, with the understanding that this release extends to the parents and/or guardians of minors. If a parent or guardian of a minor User believes that the latter has contacted FisioFlaminio, they must immediately notify the Data Controller, who will delete the minor User's Personal Data.

7. DATA RECIPIENTS 

Within the limits relevant to the processing purposes indicated, User data may be communicated to Collaborators, consulting firms, hosting providers, and IT companies. 

If recipients process personal data on behalf of the Data Controller, they will be appointed as data processors pursuant to Art. 28 GDPR.

8. TRANSFER OF DATA TO A THIRD COUNTRY 

FisioFlaminio will not share the data collected with services located outside the European Union.

9. STORAGE PERIOD 

In accordance with the principle of storage limitation (Article 5, GDPR), the obsolescence of stored data is checked periodically for the purposes for which it was collected. Specifically: 

  1. a) the data collected during contact are processed for the time strictly necessary to achieve the purpose for which, from time to time, they are collected directly from the User. 
  2. b) the data collected automatically is processed, for the time strictly necessary, for the sole purpose of obtaining statistical information on the use of the platform and to monitor its proper functioning, including for security purposes or in accordance with the deadlines established by Italian law;
  1. c) the data provided voluntarily by the User will be retained for a period of time no longer than is necessary to achieve the purposes for which they are processed or in accordance with the deadlines established by Italian law.

10. RIGHTS OF THE INTERESTED PARTY 

The interested party always has the right to request from the Data Controller access to his/her data, rectification or cancellation.  of the same, the limitation of the treatment or the possibility to oppose the treatment, to request the  data portability, to withdraw consent to the processing by asserting these and other rights provided for by the  GDPR by simply communicating with the Data Controller. The interested party may, in any case, lodge a complaint  to a supervisory authority

11. DATA PROCESSING METHODS 

The Personal Data provided by Users will be processed in compliance with the aforementioned legislation and the confidentiality obligations that inspire the Data Controller's activities. The data will be processed using both computerized tools and paper-based media, as well as any other suitable media, in compliance with the appropriate security measures pursuant to Article 5, paragraph 1, letter F, of the GDPR.

12. FINAL NOTES AND UPDATE METHODS 

This information applies only to this Site and not to other websites and/or mobile apps that may be accessed by the user via links on this Site. This information may be subject to change due to the introduction of new regulations. The Data Controller will promptly inform Users of such changes. Users are encouraged to periodically review the Privacy Policy to stay up-to-date.
